Lawsuit Filed Against State of Washington Department of Licensing
Press Release – Olympia, WA – Large Public Records Act Lawsuit Filed Against State of Washington State of Washington Department of LicensingOn Tuesday October 6th, 2009 a lawsuit was filed in Thurston County Superior Court against the State of Washington Department of Licensing. The lawsuit, which can be viewed or downloaded online at http://georgenervik.com/PRA/Nervik-vs-DOL-Thurston-Superior-09-2-02385-6/Liz-Luce-Emails.htm alleges in a verified complaint that Department of Licensing has refused to turn over tens of thousands of electronic email records relating to the Department of LicensingDirector, Elizabeth A. “Liz” Luce.
The public records requests, first filed in December 2005 and refilled several times after that, have never been completed by the State, subjecting them to penalties that may well be the largest in the State’s history for violating the Public Records Act under RCW 42.56.
The State, which was served with a copy of the lawsuit on Wednesday October 7th, 2009 has yet to file an answer with the Court or the Plaintiff. Supporting documentation for the summons and complaint can also be found on the website.
